Terms of Service

LeaseDesk is record-keeping software. It is not a party to your lease, it does not move money, and it does not provide legal advice. Sections 2, 6 and 10 explain what that means in practice.

1. Agreement to these terms

These Terms of Service govern your use of LeaseDesk at leasedesk.app, operated by [LEGAL ENTITY]. By creating an account or using the service, you agree to them. If you do not agree, do not use LeaseDesk.

2. What LeaseDesk is, and is not

LeaseDesk is software that helps landlords, tenants and contractors record and coordinate property management activity. We provide the platform only.

LeaseDesk is not:

  • a party to any lease, tenancy or work agreement recorded on the platform
  • a landlord, property manager, letting agent or real-estate broker
  • a payment processor, escrow agent, money transmitter or bank
  • a consumer reporting agency, tenant screening bureau or credit bureau
  • a provider of legal, tax, accounting or financial advice

Agreements between landlords, tenants and contractors are between those parties. We are not responsible for their performance, conduct, or the accuracy of anything they enter.

3. Eligibility and accounts

  • You must be at least 18 and able to enter a binding contract.
  • You must give accurate registration information and keep it current.
  • You are responsible for everything done under your account, and for keeping your password and mobile passcode confidential.
  • Tell us promptly if you believe your account has been compromised.
  • Accounts are assigned a role — landlord, tenant, contractor or administrator — which determines what you can see and do.

4. Landlord responsibilities

If you use LeaseDesk as a landlord, you decide what information to collect from applicants and tenants, and you control that information once collected. You are responsible for:

  • complying with all laws that apply to your tenancies, including fair housing, anti-discrimination, tenant screening, privacy and data protection laws
  • handling applicant information — including Social Security Numbers, dates of birth, criminal and eviction history, and uploaded identity and financial documents — lawfully and securely
  • obtaining any consent or authorisation required before screening an applicant
  • giving any notice the law requires when you decline an applicant
  • the accuracy of property, lease, rent and screening records you enter

Using LeaseDesk does not make your tenancy decisions lawful. We do not review them and take no responsibility for them.

5. Tenant and applicant responsibilities

  • Information you submit in an application must be true and complete.
  • Submitting an application does not guarantee approval or create a tenancy.
  • Only upload documents you have the right to share.
  • You understand that the landlord for the property you apply to will be able to see the full contents of your application.

6. Payments are recorded, not processed

Rent and contractor payments shown in LeaseDesk are records of payments made elsewhere. LeaseDesk does not accept, hold, transmit or disburse funds, and does not collect card or bank account details.

Marking an amount as paid inside LeaseDesk does not transfer money and is not proof of payment. Rent obligations, late fees and payment disputes are governed by your lease and by law, not by what this software displays. Please do not enter card numbers or bank account details into free-text fields.

7. Maintenance and contractor work

  • Contractors listed on LeaseDesk are independent; they are not our employees, agents or subcontractors.
  • We do not verify a contractor's licensing, insurance, qualifications or work quality. Landlords are responsible for their own due diligence.
  • Cost estimates, quotations and approvals recorded on the platform are between the landlord and the contractor.
  • Contractors assigned to a ticket can see the property address and the reported problem, and must use that information only to perform the work.

8. Acceptable use

You agree not to:

  • use LeaseDesk unlawfully, or to discriminate against any person
  • access data belonging to another user, or try to escalate your role or permissions
  • upload malware, or probe, scan or test the security of the service without our written permission
  • scrape, harvest or bulk-export data about other users
  • impersonate another person, or misrepresent your relationship to a property
  • interfere with or place unreasonable load on the service

9. Your content

You keep ownership of the content you upload. You grant us a limited licence to host, store, reproduce and display it solely to operate the service for you and those you share it with. You are responsible for having the rights to what you upload.

The LeaseDesk name, logo, software and design are ours and may not be copied or used without permission.

10. No professional advice

Nothing in LeaseDesk — including templates, prompts, field labels, and calculated figures — is legal, tax, accounting or financial advice. Lease and tenant screening requirements vary by jurisdiction and change over time. Consult a qualified professional for your situation.

11. Third-party services

We rely on third parties to operate LeaseDesk, including Microsoft Azure for hosting and Postmark for email. Their availability affects ours, and we are not liable for their failures.

12. Availability and disclaimers

LeaseDesk is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that records stored in it will be free of loss or inaccuracy. Keep your own copies of records you rely on for legal, tax or accounting purposes.

13. Limitation of liability

To the maximum extent permitted by law, LeaseDesk and [LEGAL ENTITY] will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost rent, lost data or reputational harm, arising from your use of the service.

Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless LeaseDesk and [LEGAL ENTITY] from claims, damages and reasonable legal fees arising from your use of the service, your content, your breach of these terms, or your violation of any law or of the rights of another person.

15. Suspension and termination

You may stop using LeaseDesk at any time and ask us to close your account. We may suspend or terminate access if you breach these terms, if we are required to by law, or to protect the service or its users. Sections 9 through 14 survive termination.

16. Changes to these terms

We may update these terms. We will revise the date at the top of this page, and we will notify account holders by email of material changes. Continuing to use LeaseDesk after a change takes effect means you accept the revised terms.

17. Governing law

These terms are governed by the laws of [JURISDICTION], without regard to its conflict of law rules. The courts of [JURISDICTION] will have exclusive jurisdiction over any dispute, except where the law gives you the right to bring a claim elsewhere.
